Barclays to pay $400M-plus to settle LIBOR charges

NEW YORK (AP) -- Barclays PLC and its subsidiaries have agreed to pay more than $400 million to settle charges that it attempted to manipulate and made false reports related to setting key global interest rates.

The rates affect the costs of hundreds of trillions of dollars in loans and investments such as bonds, auto loans and derivatives.

The U.S. Commodity Futures Trading Commission said Wednesday that the incidents occurred between 2005 and 2009 and sometimes took place daily.

The CFTC said Barclays senior management and multiple traders were involved in the matter and that they also coordinated with traders at other banks to make false submissions.

"Banks must not attempt to influence LIBOR or other indices based upon concerns about their reputation or the profitability of their trading positions," CFTC Chairman Gary Gensler said in a statement.

The data was used in determining the London interbank offered rate ? known as LIBOR? and Euribor rates, which influence many other interest rates.

The LIBOR is an average rate set by banks each morning that measures how much they're going to charge each other for loans.

Barclays' settlement with the CFTC includes a $200 million civil penalty. Britain's Financial Services authority levied a fine of 59.5 million pounds ($92.7 million), the biggest fine ever imposed by the British regulator. Barclays also agreed to pay $160 million as part of an agreement with the fraud section of the Justice Department's criminal unit on a related matter.

Barclays President Bob Diamond also announced he and three senior bank executives were waiving any bonus for the year as a result of the case.

The other executives include Group Finance Director Chris Lucas, Chief Operating Officer Jerry del Missier and Chief Executive of Corporate and Investment Banking Rich Ricci.

With polls closed, Egypt waits for president

CAIRO (Reuters) - Egyptians began an anxious wait for their first freely elected president on Sunday after two days of voting that was to be the culmination of their Arab Spring revolution but which many fear may now only compound political and economic uncertainty.

The Muslim Brotherhood said its Islamist candidate Mohamed Morsy was leading in early local counts by two to one over Ahmed Shafik, a former general who was prime minister when Hosni Mubarak was overthrown. But there was no official tally and no meaningful independent polling on the head-to-head ballot.

Should Morsy win, he may find his powers restricted.

Having dissolved the new, Islamist-led parliament on the eve of the vote, the ruling generals were preparing a decree to set limited powers for the new president and raise the prospect that a body appointed by the military may draft a new constitution before another legislative election in a few months time.

It was unclear how soon any firmer indication of the result would emerge. After a first round of voting last month, which knocked out several popular candidates, it took several hours.

On Monday, the new president, whether Morsy or Shafik, will be told, along with the rest of the country, what powers he will have by the ruling generals, military and legal sources told Reuters. The military council would take back legislative powers for now from a parliament captured by Islamists in January, while the president would have powers to name a new government.

Turnout, only 46 percent in the first round of the presidential vote, appeared to electoral officials to have been no higher for the decisive head-to-head contest. Many of the 50 million eligible voters were dismayed by an unpalatable choice between a man seen as an heir to Mubarak and the nominee of a religious party committed to reversing liberal social traditions. Some cast a ballot against both men in protest.

"I'll cross out both Morsy and Shafik because neither deserve to be president," said Saleh Ashour, 40, a shopkeeper in the middle-class Cairo neighbourhood of Dokki as he went to vote. "I want to make a statement by crossing out the two names.

"Just staying away is too passive."

COMPETING VISIONS

Shafik, 70, had vowed that he had heeded the lessons of the revolution 16 months ago and offered security and prosperity. Morsy, 60, tried to widen his appeal beyond the Brotherhood's committed and disciplined base by pledging to preserve a pluralist democracy and finally end a history of military rule.

In the second city, Alexandria, computer engineer Sameh Youssef, 30, was wary of Islamist rule but wanted to honour the dead of an uprising launched by frustrated young urbanites: "I will vote Morsy," he said. "Not because I like him but because I hate Shafik. Between us and Shafik there is blood."

In Old Cairo, however, 56-year-old physician Khalil Nagih echoed the sentiments of many, including Christians like himself, whose mistrust of the Brotherhood and desire for an end to a year of chaos outweighed anxiety about the army's role:

"I chose Shafik because he has experience of administration and was an officer. He is a straight talker and he speaks to all communities. He says he'll solve our problems and I believe him. Morsy will bring a religious state and take Egypt backwards."

MILITARY DECREE

Whoever wins, Egypt's political landscape is hazy beyond one clear landmark - the 20 or so senior commanders around Field Marshal Hussein Tantawi, whose Supreme Council of the Armed Forces (SCAF) claimed sovereign power after easing out their brother officer Mubarak to appease the millions on the streets.

In what opponents denounced as "coup", the SCAF dissolved parliament after judges, all appointed under Mubarak, ruled on Thursday that the legislative election over the winter breached legal rules and would have to be re-run.

The Brotherhood and hardline Islamist allies dominated the new chamber, and risk losing seats in any new vote, having alienated many outside their core support base. Among failings they are accused of was the inability to form a consensus body to draw up the new constitution Egyptians are hoping for.

As presidential voting was ending, military and legal sources told Reuters that the military council would promulgate an amended constitutional decree on Monday returning to itself the legislative powers it handed to parliament this year.

"In the absence of parliament, legislative powers move back to the military council, which has been in charge of the country and will hand over presidential powers to the president soon," a military source told Reuters.

The decree would also define the new president's powers: "The country's head of state will have the power to appoint a prime minister and cabinet ministers," the military source said.

A lawyer who attended a meeting with the military council on Sunday said: "The presidential powers which the military council held until now will now shift to the new president."

Among other provisions, the drafting of a new constitution which had been delegated to a body chosen by parliament might be handed to a new panel appointed by the military council if the parliamentary group failed to pass a judicial review. Any new constitution would be put to a referendum before a new election for the legislature would be held, the sources said.

"COUP" WARNING

The Brotherhood has rejected the army's power to dissolve parliament and warned of "dangerous days". But though some have compared events to those in Algeria 20 years which ended in civil war between the military and Islamists, many doubt that the Brotherhood has an appetite for violence at present.

Many opponents of military rule have also complained that the Brotherhood has overreached itself in seeking both legislative and presidential power, limiting its broader appeal.

Egyptians massed in their millions against Mubarak in January last year in the hope that his removal would end poverty, corruption and police brutality. Many now seem tired of the social turmoil and political bickering that ensued.

"Egypt writes the closing chapter of the Arab Spring," read a headline on Sunday in independent newspaper al-Watan, which said the election offers a "choice between a military man who aborted the revolution and a Muslim Brother who wasted it".

Monitors said they had seen only minor and scattered breaches of election rules by Sunday morning but not the kind of systematic fraud that tainted elections under Mubarak, despite mutual accusations of irregularities by the rival camps.

A win for Shafik may prompt street protests by the Islamists and some of the disillusioned urban youths who made Cairo's Tahrir Square their battleground last year. Should Morsy prevail, he may be frustrated by an uncooperative military elite, for all the generals' pledges to cede power by July 1.

Egypt's armed forces have built up massive wealth and commercial interests, helped since the 1970s by a close U.S. alliance which followed the decision of the most populous Arab state to make peace with Israel.

Many Egyptians say the army is just one wing of an entrenched security establishment that has resisted reform and oversight since Mubarak left and would wield influence long after the promised handover to an elected civilian.

"There is no doubt that the state in all its institutions - judicial, military, interior, foreign and financial - back Shafik for president and are working to that end," said Hassan Nafaa, a politics professor who campaigned against Mubarak.

"It is very difficult to eradicate this spirit of Mubarak."

The body of Timothy Jorden was found in the woods along Eighteenmile Creek behind his home in Lake View, N.Y.?One of Jorden?s neighbors had told police Thursday that he heard a gunshot in the area around 9 a.m. on Wednesday morning.

Police launched a nationwide manhunt for?Jorden, 49,?after hospital administrative assistant Jacqueline Wisniewski, 33,?of West Seneca,?was?found?dead in a stairwell at the Erie County Medical Center in Buffalo.

Jorden was considered armed and dangerous. He?joined the National Guard in high school, went into the Army after graduation and served with the Army?s Special Forces, first as a weapon?s expert, then as a medic in the Caribbean, Japan and Korea.

Police Commissioner Daniel Derenda?at a Friday evening news conference said Jorden apparently planned the killing and suicide. Jorden, he said, had withdrawn about $36,000 and had been giving away gifts of cash.

No suicide note was found, Derenda said.

A?personal video surveillance system at his home showed Jorden?returned?to his residence?at 8:37 a.m. immediately following the shooting at the hospital, returned to his car and?re-entered the house and?four minutes?later went out his back door?to the woods behind his home, he said.?Hamburg and Buffalo police found the body Friday morning. A handgun of the same type used in the killing was found in his hand, Derenda said.

Hospital video had shown Jorden toting a handgun and a shotgun before the shooting, he said. Jorden apparently lured Wisniewski to the stairwell through a 17-minute phone conversation with her. He shot her five times with the handgun, Derenda said.

A friend of Wisniewski?s told WIVB-TV that she used to live with Jorden but left him because she believed he was having affairs with other women. But, Heather Shipley said, ?when they broke up, he wouldn?t let go.?

She said Jorden had once held Wisniewski captive in her home for a day and a half, wielding a knife, and he also put a GPS tracking device in her car.

?She told me if anything happened to her,? Shipley said, ?that it was him.?

A nationwide manhunt continues for Dr. Timothy Jorden, a surgeon in Buffalo, N.Y., suspected of murdering a receptionist, who was also his ex-girlfriend, at the Erie County Medical Center Wednesday.

Neighbors and colleagues said they suspected something was wrong with Jorden, a decorated surgeon and respected community member, when he began putting less effort into things he previously cared about, became less friendly, and changed his appearance.

?I saw him at the beginning of the season and noticed how much weight he had lost,? June DuPree, a neighbor of Jorden?s in an exclusive cluster of homes on the shore of Lake Erie, told the Associated Press. ?He said, ?Yeah, I lost a little bit.? But it was more than a little bit. It was a lot. He wasn?t too friendly that time I saw him. He just didn?t want to talk.?

One of Jorden?s colleagues estimated Jorden had dropped about 75 pounds in recent months.

A police official told the Buffalo Newsthat Jorden may have been having mental health issues or ?some type of serious physical ailment that caused the drastic weight loss.?

Jorden's office may offer clues to his mental status. A police source said it appeared he had been living in the office. Hidden above ceiling tiles, police found rancid takeout containers and dirty laundry, the Buffalo News reported.

Jorden has been licensed to practice medicine in New York for a decade. He has a medical degree from the University of Buffalo and trained at the Madigan Army Medical Center in Tacoma, Wash. He received his certification from the American Board of Surgery in 2004.

LAGOS, Nigeria (AP) ? A Nigerian airline whose airplane crashed in the country's largest city, killing 153 on board and more on the ground, defended itself against growing public criticism, saying its own chief engineer died on the doomed flight.

Francis Ogboro, an executive who oversees Dana Air, also told journalists the MD-83 that crashed Sunday underwent strenuous checks like the others the carrier owns and that he routinely flies.

Emergency officials on Wednesday stopped searching for those killed at the crash site in Iju-Ishaga, the Lagos neighborhood about nine kilometers (five miles) from Lagos' Murtala Muhammed International Airport. Searchers there recovered 153 complete corpses as well as fragmented remains before halting their efforts, said Yushau Shuaib, a spokesman for Nigeria's National Emergency Management Agency.

It is unclear from the fragments collected how many victims there are, officials said, acknowledging that a complete death toll could likely take weeks.

"I think we can only be sure of the number at the end of the scientific investigation that is going on," Lagos state attorney general Ade Ipaye said.

Officials now plan to survey the neighborhood to find who remains missing after the plane smashed into two apartment buildings, a printing business and a woodshop, Shuaib said. Those still missing would be presumed dead until DNA testing or other forensic tests links them to the dead, officials said.

During a news conference Wednesday, authorities said relatives of the dead should come to Lagos to provide tissue samples and be photographed. However, such DNA testing likely would need to be done outside of Nigeria, a nation with erratic electricity from a state-run power company and a largely mismanaged government.

The cause of the crash on a sunny, clear Sunday afternoon remains unknown. The flight's captain radioed Lagos as the aircraft approached and declared an emergency, saying both of the MD-83's engines had failed, Aviation Minister Stella Oduah said Wednesday. The plane crashed minutes later.

Ogboro and others declined to speculate what could have made both of the aircraft's Pratt and Whitney engines go out in the last minutes of the flight.

Authorities already have collected the flight voice and data recorders from the airplane and plan to send them to the United States for analysis Thursday, Oduah said. The U.S. National Transportation Safety Board also has sent an investigator to assist Nigeria's Accident Investigation Board, which probes airplane crashes.

Families and diplomats continued to attempt to identify the dead, hampered by conflicting flight manifests.

On Wednesday, U.S. State Department spokesman Mark Toner said the number of dead American citizens in the crash had risen to nine from seven.

Britain's foreign ministry said that Antonia Attuh, a woman with dual Nigerian and British citizenship, died in the crash. Indian diplomats also believe Indian national Rijo K. Eldhose and flight co-pilot Mahendra Singh Rathore, an American of Indian origin, also were killed, said Rani Malik, an officer at India's High Commission in Lagos.

Others killed in the crash included at least seven Americans, at least four Chinese citizens, two Lebanese nationals, a French citizen and a Canadian, officials have said.

Popular anger has risen in Nigeria against the airline since the crash. On Tuesday, the Nigerian government said it had indefinitely suspended Dana Air's license to fly as a safety precaution. However, while offering sympathy for those who died in the crash, Ogboro predicted the airline would resume operations within a few weeks after proving to the government its fleet of MD-83s are safe.

"We ensure that we go by the rules," he said. "I am almost certain they will find that we have not done anything contravening the aviation rules, because all of those aircraft are well maintained. There's absolutely no doubt about that."

Identifying the dead likely will take longer, officials say. At the site Wednesday, a worker in a yellow safety vest flipped through a photo album pulled from the debris, a series of photographs of weddings and christenings smeared with mud.

Nearby, a crane lifted up the tail of the crashed plane as workers began to remove pieces of the aircraft from the site. Fresh black paint covered the faded Dana Air logo on the fuselage.
